I have attached a copy of the Court Case that I filed today against the Alabama Governor Bob Riley, DNC Obama and RNC McCain.
 
The Constitution clearly prohibits sitting Senators from being Electors. In this November 4, 2008 election we had Joe Biden, Barack Obama and John McCain, all three are sitting Senators (Article II, Section 1, Clause 2:
 
"Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector."
 
It is my understanding this same case is also being filed in 21 other States at this time either today or tomorrow.  That should get the ball rolling!

             MEMORANDUM FOR THE RECORD
 
ON DECEMBER 4, 2008 AT 12:04PM my Court Case Petition And For Extraordinary Writ of Prohibition was received and stamped by the Montgomery County Circuit Court In The State Of Alabama. This was done only after I had paid the Court Clerk $321.00 and she wrote out the receipt for me.
 
She informed me that since the case had been walked-in that they would have to process it before they could issue a Case No. and Assign a Judge to the Case. This could take up to three days. However, if I had electronically filed this case then I would have then received a case number and a Judge. Electronic Filing of course is reserved for Lawyers which I am not. Is this just another form of discrimination?
 
In any event I explained to the Court Clerk, Ms. Jane Murphy, that this was a very important case that required immediate attention and I would appreciate any efforts she could make in getting this case docketed.  She said I could call her at (334) 832-1263 tomorrow to see if it had been docketed and obtain a Case Number. You can bet I will stay on top of this until I am given a Case Number.
 
I do have for my records the Courts stamped copy of the Complaint and the three Civil Summons's as filed. In Alabama the Summons and Complaint are delivered by the Sheriff's Department.
